On February 5th, President Andrés Manuel López Obrador sent an initiative to the Chamber of Deputies to reform Article 123 of the Constitution in its twelfth section, regarding the right to housing.
Among the most notable objectives of this proposal, we can find:
- INFONAVIT (National Workers’ Housing Fund Institute) can build housing for workers to acquire or obtain them under the social rent scheme. The monthly payment charged to workers cannot exceed 30% of their salary.
- Any worker, having contributed for a year, can access INFONAVIT rental housing and will have the right to acquire it if they maintain rental payments for ten years.
- Preference will be given to workers with greater seniority in contributions and who do not own a home.
This reform seeks to help workers obtain housing closer to their workplaces and provide an opportunity
for those with fewer resources to obtain decent housing.
For employing companies, it is of paramount importance to understand the proposed reforms as they modify the obligation to “provide
rooms” to “provide housing,” as well as the establishment of a system of socially oriented homes for workers.
