On October 17, 2024, draft Mexican Official Standard NOM-087-SICT-2-2024, which regulates driving times and breaks for drivers in federal trucking services, was published in the Official Journal of the Federation. This standard establishes new obligations for employers, who must ensure that drivers take 30-minute breaks after five continuous hours of driving and do not exceed a maximum of 14 hours of driving in a 24-hour period. In addition, they must implement electronic or physical logbooks to record these times.
Employers would be required to adjust their operations to comply with these provisions. On the other hand, it is important to note that the hours of service log will be reviewed by the National Guard, in collaboration with the Ministry of Infrastructure, Communications and Transportation, who will supervise its correct implementation. Penalties for non-compliance with this regulation will be applied in accordance with the corresponding laws.

The draft is open for public comment for the next 60 days. It is critical that employers review their policies and adjust driving times, breaks and required documentation before the rule goes into effect. Failure to comply could result in significant penalties.
