On October 2, 2024, the Chamber of Deputies unanimously approved the initiative that reforms various provisions of the Federal Labor Law (LFT) regarding the right to rest during the workday, better known as the “Chair Law“. The purpose of this reform is to guarantee that workers have a seat with a backrest to rest during the workday, marking a milestone in the protection of labor rights.
Keys to the Reform:
- Right to Rest in Seat: Employers shall be required to provide sufficient chairs or seats with backrests for workers to rest during their workday, especially in sectors such as services, commerce and security, where a lot of time is spent standing.
- Incorporation in Internal Work Regulations: Companies should adjust their internal regulations to reflect the new rest periods and the use of seats.
- Legislative Process: The Chamber of Deputies has now sent the opinion to the Senate of the Republic to continue its legislative process. It is expected that the Senate will endorse the proposal, given the unanimous support of the different parliamentary groups in the Lower House.
- Implementation Deadlines: Once approved and published, companies will have 180 days to adjust their internal regulations to the new provisions. The Ministry of Labor and Social Security (STPS) will have 30 days to issue the corresponding regulations.
Companies should be prepared to review their internal labor policies and regulations, as well as individual employment contracts, to ensure compliance with the “Ley Silla” once it is approved and published.
