Initiative for labor equity for youth without experience

On March 12 of the current year, Congressman Alan Castellanos Ramírez presented an initiative to amend articles 3 and section I of article 133 of the Federal Labor Law, which establishes as discriminatory any job application that requires previous experience for the hiring of young individuals.

According to what was proposed in this initiative, companies should not request previous experience in job applications. Additionally, young people should not be rejected solely because they lack work experience.

The proposal aims to provide more opportunities for individuals who are starting their careers. It points out that this situation arises from various problems faced by young people, such as a lack of job opportunities, limited training programs, insufficient skill development, as well as the absence of specific mechanisms and programs that facilitate their integration into the labor market. It emphasizes that Mexican youth are particularly affected by widespread unemployment.

To ensure compliance with this proposal, it is recommended to minimize the request for recommendation letters and avoid including the requirement of previous experience in job offers targeted at young people as much as possible.

In case of non-compliance, according to labor regulations, a penalty equivalent to 50 to 5000 times the Unit of Measure and Update will be imposed.

Currently, this initiative has been presented to the plenary of the Chamber of Deputies, and its discussion is pending in the Labor and Social Security Commission, followed by a vote in the plenary of the Chamber of Deputies. If it obtains a majority vote, it will be forwarded to the Reviewing Chamber, which is the Senate of the Republic, for analysis, discussion, and potential approval, to become law, which will come into effect the day after its publication in the Official Gazette of the Federation.
