Paternity leave in Mexico: initiative for its extension

On February 18, 2025, Senator Beatriz Silvia Robles Gutiérrez (Morena) presented an initiative to amend the Federal Labor Law (LFT) and the Mexican Foreign Service Law to extend paternity leave from five to ten working days with pay.

What is the objective of the reform?

The proposal seeks to promote parental co-responsibility and strengthen the family bond from the first days of a child’s life. It also recognizes the active participation of fathers in the care of their children and proposes to standardize this right for Mexican Foreign Service workers.

Impact on employers

If this reform is approved, employers will have to adjust their paternity leave policies, extending the period of paid leave for workers who become fathers due to birth or adoption. This could imply adjustments in human resources planning and operating costs. Unlike maternity leave, which is covered by the IMSS through the corresponding insurance branch, paternity leave is paid entirely by the employer.

Current status

The initiative has been submitted to the Senate and is pending analysis in commissions. There is still no estimated date for its ruling.
