Today, September 30, the decree that modifies Article 74 of the Federal Labor Law (LFT) was published in the Official Journal of the Federation (DOF), officially establishing October 1 as a mandatory day of rest every six years, coinciding with the transfer of the Federal Executive Power.
Key Points:
- Mandatory Day of Rest Confirmed: The decree published in the DOF establishes that, as of tomorrow, October 1, this day will officially become a non-working day every six years, replacing December 1.
- Immediate Entry into Force: According to the transitory article of the decree, it will enter into force on October 1, 2024, which means that companies must immediately comply with this new provision.
- Employer’s Obligations: Employees rendering services on this day shall be entitled to receive their daily salary plus double for the day worked, in accordance with Article 75 of the LFT.
Actions to be Taken:
Companies should adjust their labor policies immediately to comply with the new legislation. Likewise, it is important that they review their individual employment contracts, since in practice some of these contracts specifically list non-working days. In such cases, it will be advisable to make the necessary modifications or updates to reflect this new provision.
