VELAVO, the alternative mechanism to Ordinary Labor Inspections

With the aim of promoting and strengthening compliance with labor legislation in work centers; thereby ensuring decent conditions for all workers; and supporting such work centers in complying fully and correctly with the labor legislation, the Ministry of Labor and Social Welfare (STPS) has developed an alternative mechanism different from labor inspections, based on self-verification through the Voluntary Labor Verification Program (VELAVO). The main objective of this program is that the employer, by its own decision, fully complies with the labor legislation in matters of:

  1. General working conditions;
  2. Training and education; and
  3. Safety and hygiene.

At the time of registration to VELAVO through the digital platform, workplaces must first declare, on a mandatory basis, the status of compliance with the General Working Conditions. Once the total accreditation in this matter has been verified, the work centers may voluntarily decide if they wish to obtain accreditation in “Training, Training and Productivity.” and/or in “Occupational Safety and Health.” (noting that only those work centers classified as risk classes I and II will be subject to this matter).

The benefit of accreditation through this mechanism is that the work centers that are registered and comply with the requirements of the voluntary compliance program will be exempt from the ordinary inspections carried out by the STPS for a period of one year. This benefit is renewable from year to year.

However, it is important to mention that, in order to obtain the benefits of VELAVO, it will be necessary to complete the questionnaires and provide documentation through the corresponding platform. It is essential that the information provided is authenticated by means of the E.signature of the legal representative of the Company and the corresponding Federal Taxpayer Registry. In case of providing false information, the STPS will order the practice of extraordinary inspections in the corresponding work center, without prejudice to the imposition of the applicable sanctions for falsifying documents before the Authority.
