Legal Basis

On November 13, 2020, a labor jurisprudence was published recognizing the right of foreign workers to claim the refund of their contributions upon permanently leaving Mexico. This includes:

What Are AFORE and Infonavit?

AFORE: Retirement Fund Administrator

  • An individual account funded by contributions from the worker, the employer, and the government.
  • Generates long-term returns.
  • Can be claimed once you no longer reside in Mexico.

INFONAVIT: National Housing Fund Institute for Workers

  • A housing fund that receives 5% of the worker’s base salary.
  • If you didn’t use a housing loan, the accumulated balance can be claimed.

Infonavit Recovery if You Didn’t Use Your Housing Credit

If you didn’t exercise your Infonavit credit, the money remains in your housing sub-account and continues generating returns. As a foreigner, you can still recover these funds even if you no longer reside in Mexico.

Check if you have a balance:

  • On your AFORE account statement (look for “housing sub-account”)
  • With help from our legal team

Legal Process Duration

Stages of the process:
  1. Conciliation (Pre-litigation): Filing with the Labor Conciliation Center (1–2 months)
  2. Labor Lawsuit: Filing of the claim (5–7 months)

Estimated total: 6 to 9 months. In the case of an amparo (constitutional appeal), it may take longer.

Important: Your funds will continue to earn returns during this time.

Recommendation: Keep a Mexican bank account active to facilitate the transfer once the case is resolved.
