Senate approves the Silla Act – Impending changes for employers

On December 4, 2024, the Plenary of the Mexican Senate unanimously approved the Chair Law, a key reform to the Federal Labor Law (LFT) that guarantees the right of workers to rest in seats with backrests during their workday. This important change aims to improve working conditions and prevent health risks derived from standing for prolonged periods of time.

Key aspects of the reform:

1. Obligations for employers: It will be mandatory to provide sufficient seating for workers in sectors such as commerce and services. In industries, it will apply only when the nature of the work allows it.

2. Internal work regulations: Companies should include clear rules on rest periods and the use of chairs with backrests.

3. Deadlines for implementation:

Entry into force: The decree will enter into force 180 calendar days after its publication in the Official Gazette of the Federation.

Complementary standards: The Secretary of Labor and Social Security (STPS) will issue, within the first 30 days after the entry into force, the specific standards on occupational risk factors related to these provisions.

Internal adaptation: Companies will have 180 calendar days from the date of entry into force of the decree to adapt their internal regulations in accordance with Section V of Article 132 of the LFT.
