Vote for my collective bargaining agreement from my cell phone

As of the Labor Reform of 1st May 2019, the process for the comprehensive review of a collective bargaining agreement (hereinafter “CBA”) means that the agreements reached between the Company and the Unions must be approved by most of the employees to whom said contract is applicable. The Federal Labor Law establishes that this consultation will be carried out through a free and secret ballot.

Since the reform came into force, various companies carried out democratic exercises in their workplaces to formalize the CBA review process. However, on 1st March, Telcel employees carried out the consultation through the Remote Labor Voting System (hereinafter “SIRVOLAB”). That system is a platform designed and developed by the Ministry of Labor and Social Security that allows employees to cast their votes through digital devices with internet access.

The platform has various means of identifying the employee who will cast their votes, such as entry by employee number, photo and video record of the user’s face, and personal verification code.

This next 22 March, the Union of Employees of the Federal Judicial Power will make use of the said platform to carry out the election of its national executive committee.

In virtue of the above and considering that the operation of the system begins with the loading of information from both the Union and the Company, this turns out to be a new option to carry out the consultation processes, which are part of the constant review which must be carried out every two years at the current CBA.

If you require more information on the use of the platform for your Company’s internal processes, please contact Vega, Guerrero & Asociados’s, labor team.
