A job change can be a great career opportunity. But if you are a foreigner in Mexico, it also entails immigration obligations that you cannot overlook. Whether you have temporary or permanent residency, it is important to know what to do before the National Immigration Institute (INM) to keep your status of stay in order.
When should I notify the INM?
If you have changed employers in Mexico, you have 90 calendar days to inform the INM. This applies to both temporary and permanent residents. Failure to give notice or late notice may result in a fine, as established in Article 158 of the Immigration Law.
It is important to remember that a “change of job” is considered only when the employer registered with the INM changes, not when you change position, office or branch within the same company.
What if I have more than one employer?
If you wish to work for a second employer, you must also notify the INM. Even if you continue with your current employment, the procedure is carried out as if it were a change of employment, since there is no specific procedure for adding a new employer. Therefore, it is essential to clarify that this is an addition, not a substitution.
What happens if I don’t report?
If you fail to comply with this obligation, the INM may impose financial penalties if it detects that you failed to file the notice or filed it late. In addition, a failure to comply may affect future immigration proceedings, such as renewals or changes of status.
How to do the procedure?
The notice must be submitted to the INM representative offices corresponding to your locality. Remember that it is currently necessary to make an appointment to carry out this type of procedure.
Required documents:
- Letter signed by the foreigner, in which, under oath, he/she declares the change of place of work, expressly indicating the previous and the new employer, as well as the date on which the change occurred.
- Temporary, student or permanent resident card.
- Request for processing.
- Valid passport.
Once you have gathered the documentation, you must go to the INM office corresponding to your place of residence to complete the procedure.
Also remember to notify the INM in case of:
- Change of address
- Change of nationality
- Change of name
- Change of marital status
Any such changes must also be reported within 90 calendar days of occurrence to keep your documentation and immigration status up to date and avoid penalties.
